By determination of 22 December 2011, ANACOM has approved the draft decision on the circumstances, format and procedure governing the requirements of reporting security breaches and integrity failures with significant impact on the operation of networks and services to which companies offering public communications networks or publicly available electronic communications services are subject. This draft decision also sets out the conditions by which ANACOM deems whether there is public interest in the public disclosure of this information and the content, means and schedule of this disclosure.

It was decided to submit this draft decision to the prior hearing of interested parties, under the terms of articles 100 and 101 of the Código de Procedimento Administrativo (Administrative Proceeding Code), for a period of 20 working days. The draft decision was likewise submitted to the general consultation procedure laid down by article 8 and by paragraph 4 of article 54-C of Lei das Comunicações Electrónicas (Electronic Communications Law - Law no. 5/2004 of 10 February, as amended by Law no. 51/2011 of 13 September), under which interested parties are also given 20 working days to comment.
