By determination of 22 December 2011, ANACOM has approved a position on the obligation of barring access to message-based value added services, pursuant to article 45, paragraph 3 of Lei das Comunicações Eletrónicas (Electronic Communications Law), seeking to clarify any uncertainty as to the applicability of this obligation to contracts entered into prior to the entry into force of Law no. 51/2011 of 13 September, amending Law no. 5/2004 of 10 February.

As set out in the approved position, the obligation of barring applies to all prevailing contracts agreed with companies which offer public electronic communications networks and publicly available electronic communications services supporting the provision of message-based value added services.
