By determination of 9 March 2012, ANACOM has decided, in exercising the powers provided for in paragraph 1 of article 110 of the Electronic Communications Law, to notify PT Comunicações, S. A. (PTC) to voice its opinion, wishing to, within twenty working days, on the observed failure to comply with the "1820" provision services and on the following measures deemed appropriate to rectify the situation, tending to be imposed:
- Cessation, no later than two months after notification of the resolution, of the provision of services unrelated to telephone directories through the 1820 number, such as taxi reservation services, hotels or restaurants, ticket purchases and sales, information on shows, sports results, horoscopes, traffic, weather, transport timetables or TV programming - limiting the provision of services through that numbering resource to the data available in telephone directories of telephone subscriber services, fixed and mobile, as well as other information that may be directly linked to these lists.
It was also decide, pursuant to point g) of article 9, in conjunction with point I) of article 26, both of the Statutes of this Authority, approved by Decree-Law number 309/2001, of 7 December, to recommend PTC to regularise the situation of violation of paragraph 1 of article 47 of the Electronic Communications Law, amending the information contained in the "1820" service tariff, especially the information available on the website casa.telecom.pt, as well as information provided by the customer services, to explicitly state that calls established by forwarding through the "1820" services are charged at the fixed tariff of this service, different from what would be applied when calls would be autonomously made by users.
This draft follows from inspection measures in which various irregularities were detected in the provision of services, specifically with the conditions associated with numbering resource assigned.
