ANACOM concludes analysis of market 18
ANACOM - Autoridade Nacional de Comunicações has concluded its analysis of the wholesale market of broadcasting services for the delivery of content transmitted to final users (market 18), one of the relevant markets defined by the European Commission. The EC will be notified forthwith.
In its analysis of market 18, ANACOM has identified various wholesale markets which encompass the whole national territory: the wholesale supply market of television broadcasting services through terrestrial analogue networks, the wholesale supply market of television broadcasting services through cable distribution networks, the wholesale supply market of radio broadcasting through terrestrial analogue networks in frequency modulation; and the wholesale supply market of radio broadcasting through terrestrial analogue networks in Amplitude modulation. However the relevant market for the purposes of ex-ante regulation is considered to be the wholesale supply market of television broadcasting services through terrestrial analogue networks. It is further concluded that Grupo Portugal Telecom has significant market power and as such a number of obligations are to be imposed on this undertaking, under the terms of Law no. 5/2004 of 10 February.
Among the obligations to be imposed on the PT group are the obligation of access to and use of specific network resources; the obligation of transparency in the publication of information; of non-discrimination in the access and interconnection offer and in the disclosure of respective information; the separation of accounts in respect of specific activities related to access and/or interconnection; price control and cost accounting; and the obligation of financial reports.
