Administrative Rule
In view of the need to admit reimbursements of fees in cases where disturbances to the telex service last for a certain duration and in the use of the powers conferred by subsection i), no.1, article 25 of Statute Law no. 49 368 of 10 November 1969.
The Government of the Portuguese Republic hereby orders through the Ministry of Transport and Communications the following:
Article 43 of the Telex Service for Public Use approved by Administrative Rule no. 487/72, of 22 August shall henceforth have the following wording:
ARTICLE 43
Service faults and disturbances
1 - CTT undertake to provide an efficient telex service, both in terms of the speed at which communications are established and transmission quality and to endeavour to correct delays, selection difficulties, disturbances in transmission or in interruptions in service, without, however, assuming any responsibility for the occurred faults or for their.
2 - However, should the operation of the telex service undergo, due to a fault or if required by the services, a disturbance longer than three days, the amount corresponding to the number of days that the disturbance lasted shall be discounted from the subscriber in the proportion of one thirtieth of the monthly subscription for each day of disturbance.
3 - The disturbances due to earthquakes, floods or any other cases of force majeure shall not give rise to any compensation.
