Review of the analysis of wholesale markets of network infrastructure access at a fixed location and broadband access - consultation


By determination of 6 February 2012, ANACOM has approved the draft decision on the definition of wholesale markets of network infrastructure access at a fixed location and broadband access, on the assessment of significant market power (SMP) and the imposition, maintenance, amendment or withdrawal of regulatory obligations.

In the analysis of the markets in question, the wholesale network access market and wholesale broadband access market in areas "NC" are considered as relevant markets for the purposes of ex ante regulation. It is further concluded that Grupo PT has SMP on both markets, which leads ANACOM to make provision for the imposition of obligations of network access and use of specific network resources, non-discrimination, transparency, accounting separation and price control and of cost accounting and financial reporting. In respect of access obligations, further to the obligation of local copper loop and sub-loop unbundling and access to ducts and masts throughout the national territory, in certain municipalities, ANACOM imposed an obligation in the wholesale network access market of access to optical fibre, based temporarily (while unbundled access is not feasible) on virtual access.

This draft decision was submitted to the prior hearing of interested parties and to public consultation for a period of 30 working days in each case. As such, comments are to be received no later than 22 March 2012 and should be sent by e-mail to mercados4e5@anacom.ptmailto:mercados4e5@anacom.pt 1.

Once the consultation procedure has been concluded, responses received will be published on this website. Therefore, respondents should also send a non-confidential version of their response for publication on this website, with any items considered confidential removed.
