Universal service provision of a telephone comprehensive directory and of a comprehensive telephone directory enquiry service - public consultation


By determination of 16 April 2014, ANACOM has approved the launch of a public consultation on the universal service provision of a comprehensive telephone directory and of a comprehensive telephone directory enquiry service.

The essential goal of this procedure is to compile contributions/information from the market and society to enable a subsequent evaluation of the need to continue to maintain the designation of an undertaking responsible for this provision. The consultation also aims to assess the conditions which should govern provision of this universal service component, in order to identify any changes to the current model that may be necessary, with a view, ultimately, to ensuring that the interests of end-users are safeguarded.

This consultation follows the recent award of the provision in question to PT Comunicações S.A. (PTC), by means of a direct award procedure, after no proposals were submitted to the previously conducted tender.

Indeed, by Resolution no. 70-B/2013 of 8 November, the Council of Ministers determined award of the universal service provision of a comprehensive telephone directory and of a comprehensive telephone directory enquiry service to PTC for a period of twelve months. The government's decision to use a direct award procedure was based on the need to proceed expeditiously with the designation of the provider of this universal service component; it also followed from ICP?ANACOM's call for a reassessment, in the short term, of the need to continue ensuring this provision, on the basis of universal service, and, if it is concluded that this provision should be maintained, of how it should be ensured in the future.

In this context, the government decided that the contract to be awarded as a result of the direct award procedure should remain effective only for the period necessary to undertake this reassessment, to be conducted by ICP?ANACOM, and to conclude any new tender procedure. ICP-ANACOM was therefore requested, in the context of its powers and responsibilities, to engage the procedures necessary to undertake an evaluation of the matter under consideration, so that the issues related to the means of ensuring provision of these services could be addressed and debated by all stakeholders in the context of a public consultation.

Interested parties are granted a period of 20 working days to respond to this consultation.
