Study on Regulatory Impact Analysis


ANACOM has conducted a study on Regulatory Impact Analysis (RIA), a methodology that seeks to define public policy and regulatory decisions. It is essentially an empirical method which can be analysed in addition to other methods commonly employed in regulatory decision-making.

The study identifies the objectives which RIA seeks to achieve, the implementation methodologies and advantages and disadvantages in terms of electronic communications markets and their regulation.

It also analyses case studies related to RIA implementation at the European Commission, and in the United Kingdom and Ireland. In particular, the analysis highlights the importance, in every organisation, of staff with expertise to conduct RIA reviews and provide advice to RIA authors.

Weighing all the elements, the study concludes that the principles of AIR are already broadly followed by ANACOM in its regulatory decision-making (especially as regards its analysis of relevant markets susceptible to ex-ante regulation) and other decisions impacting the market, for example in terms of spectrum management.

As such, ANACOM will continue to follow best European and international practice with regard to RIA processes and methodologies and, where relevant, seek to adapt them to its analysis and decision-making.
