Administrative Rule

Having regard to the Statutes of ICP - Autoridade Nacional das Comunicações, herein simply referred to as ICP - ANACOM, approved by Decree-Law no. 309/2001, of 7 December, insofar as they apply, taking into account the net results for 2008, which amount to (Euro) 23 856 218;

Having regard to the need to maintain in the Authority's balance the financial resources required to fulfil its assignments, namely those in paragraph 1 s) of article 6 of the Statutes;

Having regard to Order no. 28 305-A/2008, of the Secretary of State of the Presidency of the Council of Ministers, published in the Official Gazette, Series II, of 4 November 2008;

Having regard to the Government's purpose to ensure the access to the information society, in order to promote info-exclusion, namely by massifying the use of computers and broadband;

Having regard to ICP - ANACOM's draft income allocation included in its annual report for 2008;

The Government, through its Ministers of State and for Finance, and for Public Works, Transport and Communications hereby decrees as follows:

Allocation of income for 2008

1 - ICP - ANACOM's net income for 2008 shall be allocated as follows:

a) (Euro) 21,000,000 shall be transferred to the following bodies:

Fundação para as Comunicações Móveis (Foundation for Mobile Communications) - (Euro) 20,000,000;
ERC - Entidade Reguladora para a Comunicação Social (Regulatory Body for the Media) - (Euro) 1,000,000;

b) (Euro) 2,856,218 shall be transferred to the heading ''Special reserve - Investment''.

2 – The budget of ICP - ANACOM's, in the expenditure heading, is hereby amended to the amount referred in point a) of the preceding paragraph, no further procedure being required.
