Second amendment to Law n. º 31-A 98 of 14 July (approving the Television Law), as amended by Law no. 8/2002 of 11 February, and first amendment to Law no. 43/98 of 6 August (Law of the High Authority for Social Communication).

Pursuant to paragraph c) of article 161 of the Constitution, the Assembly of the Republic hereby decrees, to be effective as general law of the Republic, the following:

Article 1
Amendment to Law no. 43/98 of 6 August

Article 6 of Law no. 43/98 of 6 August shall be replaced by the following:

Appointment and dismissal of directors

2 - Regarding the appointment and dismissal of the directors responsible for the programming and information areas of the television public operator, the legal opinion mentioned in the preceding paragraph shall be binding where it presents grounds of contravention of the guarantees provided in paragraph 6 of article 38 of the Constitution.

Article 2
Amendments to Law no. 31-A 98 of 14 July

Articles 43 and 48 of Law no. 31-A 98 of 14 July shall be replaced by the following:

Public service concessionaire

3 - The members of the management board of the concessionaire of the television public service shall not be relieved of their duties prior to their term of office, except if the standing member is proven guilty of serious misconduct in carrying out his duties or in the fulfillment of relevant tasks under his responsibility, or in a situation of permanent disability.

Article 3
Entry into force

1 - The present law shall enter into on the day following the date of its publication.

2 - The new wording of article 6 of Law no. 43/98 of 6 August shall only be applicable to standing members appointed from the date of entry into force of the present statutory instrument.
