Notice

The present announcement hereby informs that by order of the Minister of Social Equipment on 7 April 2001, the public tender for the grant of a license for the establishment and operation of a Digital Terrestrial Television Platform is launched under the following terms:

1 - The object of the public tender is the grant of a license for a Digital Terrestrial Television Platform, valid for 15 years, and renewable, through the use of 7 shared radio channels in the band 470-582 MHz and 19 shared radio channels in the band 582-862 MHz, each of 8 MHz, with the scope of geographic use, and 2 exclusive radio channels, in the band 582-862 MHz, each of 8 MHz, with the scope of geographical use.

2 - The Instituto das Comunicações de Portugal (ICP), with head office in Avenida José Malhoa, no. 12, 1099 - 017 Lisbon, is responsible for the tender.

3 - The tender is governed by the terms of Decree-Law no. 381-A/97, of December 30, by the Tender Regulations approved by Administrative Rule no. 346-A/2001, of 6 April and by the Tender Specifications approved by order of the Minister of Social Equipment of 7 April 2001.

4 - The license to be granted is governed by the terms specified in point 3 as well as by the terms of Decree-Law no. 290-A/99, of July 30, and other legislation applicable to the telecommunications sector.

5 - Tender specifications are available from the public attendance service in ICP's head office, on any working day between 09.00 and 16.00, on payment of 1,500 Euros or PTE 300,723 (plus VAT) per copy.

6 - The bid submission deadline is 45 working days after the date of publication of the present order, in the form of an announcement, in the Diário da República.

7 - Bid applications shall be delivered to ICP, under the terms specified in article 10 of the Tender Regulations and in the Tender Specifications.

8 - The public act of tender to open bids shall take place at ICP at 10 am on the 1st working day after the date specified in point 6, in conformity with an announcement to be published in the press by ICP, which will also identify the location in which the public act of tender will take place.

9 - To guarantee the undertaking assumed with presentation of the bids as well as the duties inherent to the tender as specified in article 6 of the Tender Regulations, bidders must provide a bond in the amount of 1,000,000 euros or PTE 200,482,000.

10- The entity to whom the licence is granted, under the terms of the present tender, shall increase the bond to the amount of 5,000,000 euros or PTE 1,002,410,000, in compliance with the terms of article 19 of the Tender Regulations.
