Title: "Public consultation on the draft E112 Regulation"
By determination of 15 October 2008, approval was given to the launch of a consultation on a draft E112 Regulation, related to the provision to authorities responsible for emergency services of caller location information for all calls to the single European emergency call number 112.
In Recommendation 2003/558/EC, of 25 July, on the processing of caller location information in electronic communication networks for the purpose of location-enhanced emergency call services, the European Commission recommended that Member States should draw up detailed rules for public network operators.
On the other hand, the Electronic Communications Law (Law no. 5/2004 of 10 February) provides in paragraph 2 of article 51 that as far as is technically feasible, undertakings providing publicly available telephone networks and services must make information on the location of the caller available to authorities handling emergencies, for all calls to the single European emergency call number.
Also following Order no. 20791/2006, of 20 September, of the Minister for Internal Administration, that ''establishes the conditions for a swift location of calls made to the European emergency call number 112'' and of action of the work group established for the purpose, on 1 June 2007 a tracing system of calls made from publicly available fixed telephone networks and services was made available. The tracing system of calls made from publicly available mobile telephone networks and services was made available on 14 June in the Mainland and on 31 July in the Autonomous Regions.
It is important to lay down in the current regulatory framework the specifications that support the caller location solutions already implemented, the principles and rules to be complied with by undertaking providing publicly available telephone networks and services, the rules provided for in Recommendation 2003/558/EC, of 25 July, and other standards deemed necessary for the development of the E112 service, thereby giving expression tot the above-mentioned provision of Law no. 5/2004.
This is the purpose of the draft regulation now approved by ANACOM, which is subject to the regulatory procedure provided for in article 11 of ANACOM's Statutes, as well as to the general consultation procedure established in article 8 of the Electronic Communications Law, a period of 30 working days having been set for comments, taking into account ''ANACOM Consultation Procedures'' approved by determination of 12 February 2004. The deadline for reception of comments, which must be sent preferably by email to "projreg112L@anacom.pt", thus expires on 2 December 2008.
Once the consultation procedure has been completed, received replies shall be disclosed in this website. For this reason, interested parties are requested to state clearly the elements deemed to be confidential.
