Administrative Ruling no. 96/99, of 4 of February

Decree-Law no. 272/98, of September 2, establishes the regime for installing and operating a data transmission system in broadcasting (RDS) by sound broadcasting operators. Article 12 of said Decree-Law foresees that, by a joint administrative ruling of the Government members responsible for the communications and social communications areas, the applications of the RDS system, the use of which is permitted, shall be defined, as well as the technical specification of the system.
The same precept also stipulates that, by joint administrative ruling of the Government members responsible for the communications and social communications areas, the procedures to be observed in order to obtain an authorisation for operating the RDS system shall be defined.
Under these terms:
The Government, through the Ministers for Equipment, Planning and Territory Administration and the Assistant to the Prime-Minister, under the terms and for the purposes of article 12 of Decree-Law no. 272/98, of September 2, decrees the following:
1st. The technical specifications of the RDS system must comply with European norm EN 50 067, «Specifications of the radio data system (RDS)», approved by the European Committee for Electro-technical Normalisation (CENELEC) and adopted as a Portuguese norm and published in the "Diário da República" (Portuguese Government Gazette), III Series, no. 213/91, of September 16.
2nd. The sound broadcasting operator must ask the Institute for Social Communication (ICS) for the name of the programme channel (PS), by means of an application containing the following:
a) The identity of the applicant entity, including the date on which the respective permit was attributed;
b) The date on which the licence referred to in point 1 of article 24 of Decree-Law no. 130/97, of May 27, was granted;
c) The name of the desired programme channel (PS), which may have a maximum of eight characters;
d) Generic indication of the messages to be broadcast by using the radio text (RT), when one wishes to use this application.
3rd. The application referred to in the previous point must, obligatorily and as an alternative, contain two names for the programme channel (PS), in order of preference.
4th. In the case where the same names for the programme channel (PS) are requested, the final decision must successively observe the following preference criteria:
a) Greater expansion of the radio-phonic coverage scope:
b) The earliest first licensing act of the sound broadcasting station.
5th. ICS must inform the applicant and the Instituto das Comunicações de Portugal (ICP) of the name of the programme channel (PS) attributed, as well as the admissibility of using radio text (RT), whenever the elements referred to in paragraph d) of point 2 have been presented.
6th. The authorisation request for operating the RDS system shall be presented by the operators at ICP, and the application must contain the following information:
a) Name of the programme channel (PS) attributed;
b) Document issued by ICS, in which the admissibility of using radio text (RT) appears, when use of this application has been requested;
c) Request for the attribution of a programme channel identification code (PI);
d) Project identification form in accordance with the annex to the present administrative ruling, indicating the applications one wishes to use, under the terms of point 2 of the 8th section;
e) Indication of the station or stations to which they will be connected and the applications they wish to use when the use of the EON application is requested.
7th. The applicant and ICS must be notified of the authorisation for operating the RDS system.
8th. - 1 - Authorisation for operating the RDS system shall automatically confer upon sound broadcasting operators the possibility of using all the applications foreseen in norm EN 50 067, with the exception of the following applications:
a) List of alternative frequencies (AF);
b) Using applications of other stations (EON);
c) Open data applications (ODA);
d) Applications which make it possible to provide addressed public use telecommunication services.
2 - Use of the applications mentioned in paragraphs a) and c) in the previous point must be expressly requested in the application referred to in point 6 of the present administrative ruling, and operating them is only permitted when such is expressly acknowledged in the authorisation.
3 - Use of the applications referred to in paragraph d) of point 1 shall be subject to the provisions set out in Decree-Law nr. 381-A/97, of 30 December, in accordance with that foreseen in point 3 of article 3 of Decree-Law no. 272/98, of September 2.
9th. When using the RDS system, operators must observe the limits and conditions resulting from norm EN 50 067, as well as those that are established by the authorisation.
10th. Use of the traffic programme (TP) application obliges the operator to disseminate traffic information at least four times a day, twice in the morning and twice in the afternoon.
11th. The traffic advice (TA) application can only remain active throughout the period during which traffic information is effectively disseminated, except in cases where its use is carried out by the EON application.
