"The purpose of the Study was to provide input to the preparatory work of the European Commission on reconfigurable radio systems (RRS). This final report of the Study provides evidence of problems with such systems, evaluates potential regulatory responses and assesses the likely impact of various regulatory options “particularly regarding the potential use of Commission acts pursuant Articles 3(3)(i) and 4 of the Radio Equipment Directive 2014/53/EU, hereinafter the RED”. Increasing use of reconfigurable radio systems (RRS) has led to the consideration by the European Commission (EC, or ‘the Commission’) of additional actions in the implementation of the RED. Specifically, the study objectives are to: - Assess the problematic situation that radio equipment may be altered by loading software that renders it non-compliant and unsafe; - Identify the kinds of software (which here includes firmware) that can compromise compliance with the RED - and identify manufacturers of such software; - Ascertain whether software (or firmware) loading could compromise compliance with the data privacy and fraud prevention measures of the Essential Requirements under Art. 3.3(e) and (f); and - Provide an analysis of the risks of non-compliance and whether they can be mitigated by regulatory solutions, identifying what those solutions would be and the costs and benefits of risk reduction of those solutions. Furthermore, the Study considers the extent to which current market access conditions are acceptable without regulation, or, whether Delegated Acts for such regulation could be needed in the future."
