"In the context of the European regulatory framework, access for competing postal operators to the network of the incumbent is safeguarded in Articles 11, 11a and 12 of the PSD. The principles of transparency, non-discrimination and proportionality are laid down in these provisions. The purpose of this report is, in essence, to examine how these principles are transposed in the national regulatory frameworks of Member States and how they are implemented in practice. For this purpose, in February 2018 a questionnaire was submitted to the ERGP members and observers. The questionnaire has been answered by 28 NRAs. The basis of this report is formed by desk-top theoretical research and the analysis of the answers provided to the questionnaire. The outcome of the questionnaire is set out in this report and reveals that most of the Member States have implemented this regulation in their national law to facilitate access to the infrastructure and access to the postal network of the incumbent whether or not within the scope of the universal service. The report also contains country cases from Germany, Belgium and the Netherlands."
