12. SIC - Sistema de Informação Centralizado (centralized information system)


The SIC, set up by Decree-Law no. 123/2009 of 21 May, as amended and republished by Decree-Law no. 258/2009 of 25 September, aims to ensure the availability of information on the entire set of infrastructure suitable for carrying electronic communications networks.

The SIC will bring together all record information, as well as all information concerning the procedures and rules applicable to the construction of new ducts and access to existing ducts. Infrastructure construction projects will also be posted in the system, so that all operators are able to plan and participate in projects on a coordinated basis of cost sharing.

Under the law, ICP-ANACOM is charged with the design, management and maintenance of the SIC, and is also responsible for ensuring that the SIC is accessible and available, whereas the entities responsible for such infrastructure are responsible for compiling and updating relevant information and making it available.

ICP-ANACOM launched an international tender for the implementation and management of this information system in November 2010, and the administrative procedure was completed in 2011. However, in addition to the presentation of an application seeking suspension of the Public Tender, the admission of one candidate, and later the final decision, was contested in court in distinct processes. Although rulings were issued in the first and second instance in these processes, and despite a definitive ruling issued in one process - with a decision against the Applicant -, in the other case appeals remain pending, delaying the process beyond 2012.

In 2012, very few entities, including municipalities, enacted the various provisions of Decree-Law no. 123/2009, for example through the publication of regulations governing access to the public domain and access to infrastructure suitable for carrying electronic communications networks.
