Consultation closed on NFAP 2009/2010


By determination of 31 March 2010, ANACOM has given approval to the National Frequency Allocation Plan (NFAP) which will have effect in 2009/2010. Approval was likewise given to the report on the respective public consultation, launched on 23 December 2009.

The NFAP 2009/2010 updates the version in force until now (NFAP 2008), including with respect to information on usage, with reference to 28 February 2010, and information on the frequency bands which are reserved and which are to be made available in 2010. It also updates information on uses which are exempt from radio licensing and on the elimination, in accordance with Directive 2009/114/EC and Decision 2009/766/EC, of technological restrictions previously imposed in the 900 MHz and 1800 MHz bands (refarming of 900/1800 MHz).

ANACOM took into due consideration the commentary received pursuant to the public consultation from AMRAD - Associação Portuguesa de Amadores de Rádio para a Investigação, Educação e Desenvolvimento (Portuguese Association of Radio Amateurs for Research, Education and Development), APRITEL - Associação dos Operadores de Telecomunicações (Association of Telecommunications Operators), AR Telecom, Grupo Portugal Telecom (Portugal Telecom SGPS, PT Comunicações, PT Prime and TMN), Sonaecom, Vodafone and ZON, as well as 3 comments received from individual respondents. These contributions were analysed in light of the objectives of regulation set out in the Law of Electronic Communications (Law No 5/2004 of 10 February) and the positioning of the respondents in the context of the communications market.
