Transit market - public consultation


ANACOM today opens a public consultation during a period of 20 working days in connection with the definition of the market and assessment of significant market power (SMP) in the transit market in the public telephone network at a fixed location (Market 10), in the wake of the determination approved on 25 February 2005.

In the document subject to the consultation, which constitutes ANACOM’s draft decision on the matter, the conclusion is that the transit market is a residual, competitive market, no present or foreseeable market failures having been encountered and, even were they to be, application of current legislation and of the competition mechanisms is considered sufficient to rectify any failure. Therefore, ANACOM’s proposal is not to define the transit market in the public telephone network at a fixed location as a relevant market for the purpose of ex-ante regulation.

The Competition Authority has been notified to provide its opinion under the terms of Regicom (Law nº 5/2004, of 10 February), while the specific consultation procedure on this draft decision has already been put into motion before the European Commission and the national regulatory authorities (NRA) of the other Member States.
