Administrative Rule


Administrative Rule No 1473-B/2008 of 17 December, amended by Statement of Rectification No 16-A/2009 of 13 February and amended by Administrative Rule No 567/2009 of 27 May, approved the fees due for the issuance of declarations providing evidence of the rights, for the exercise of the activity of provider of electronic communications networks and services, for the allocation of rights of use of frequencies and numbers, for the use of the radio spectrum and other fees payable to ICP - Autoridade Nacional de Comunicações (ICP-ANACOM).

The code of the fee payable for each frequency band allocated for the operation of fixed wireless access (FWA) and broadband access (BWA) - 143701, given in annex iv to this administrative rule, is the same as that identified for the MMDS system (multipoint microwave distribution system), which requires correction.
Accordingly:

Under the provisions of paragraphs 2 and 3 of article 105 of Law No 5/2004 of 10 February, and of paragraph 7 of article 19 of Decree-Law No 151 - A/2000 of 20 July:

The Government, through the Minister for Public Works, Transport and Communications, has ordered the following:

The provisions of paragraph 1.3.8. of annex IV of Administrative Rule No 1473-B/2008 of 17 December, as amended by Decree No 567/2009 of 27 May, is hereby amended to read as follows:

LF represents the entire radio spectrum allocated, in MHz;

W(index 5) represents the weighting with which it is sought to reflect the social impact of the use of the radio spectrum in different parts of the country, based on the index of economic and social development:

The present Administrative Rule shall enter into force on the day following its publication.
