By determination of 31 March 2010, ANACOM gave approval to the final decision on the provision, by Radiomóvel - Telecomunicações, S.A., of a new nomadic broadband service, under the following terms:
The Management Board, in the exercise of its powers and responsibilities, conferred upon it by points b), c), f) and h) of paragraph 1 of article 6 of its Statutes, as approved by Decree-Law 309/2001 of 7 December, in pursuit of the objectives of regulation set forth in points a) and c) of paragraph 1, in point d) of paragraph 2 and point d) of paragraph 4, all of article 5 of Law No 5/2004 of 10 February, and pursuant to article 15, paragraph 1, article 20 and article 32, paragraph 2, of the same Law, determined that:
1. RADIOMÓVEL be permitted to use SMRP-CDMA 450 MHz frequencies on the respective local access network for the provision of the nomadic use broadband service, with the typical characteristics presented to ICP-ANACOM, provided that the following mandatory conditions are observed:
a) access to the service shall be provided using a terminal linked to a single and pre-determined base station (BTS) when making, receiving and maintaining communications/sessions;
b) in exceptional circumstances, where there is technical justification for such and this is recognised by ICP-ANACOM, the association of a terminal with two, or at a maximum, three pre-determined BTS may be allowed;
c) the restrictions set out in the above points must be implemented within a period of not more than 10 days following activation of the service.
2. RADIOMÓVEL be ordered to present to ICP–ANACOM, within a period of 15 working days following notification of the definitive determination, the description of the technical process underlying BTS selection with respect to the nomadic use broadband service.
3. RADIOMÓVEL be ordered to present clear and transparent information to end-users on the characteristics of the nomadic use broadband service, making clear, in particular, the following:
a) Guarantee that the service is provided exclusively in areas corresponding to the Hotspots defined for the purposes of the service;
b) The nomadic nature of the service;
c) Any limitations of indoor accessibility.
Approval was likewise given to the report on the prior hearing and of the general consultation procedure to which the corresponding draft decision was submitted, subsequent to determination of 29 October 2008.
