Resolution of dispute between Tele2 and PTC over pre-selection terminations


ANACOM has given approval to the decision on the settlement of the dispute between Tele2 and PT Comunicações (PTC) over undue terminations by PTC of pre-selection services. This follows a request presented by Tele2 under the provisions of article 10 of Law 5/2004 of 10 February (Electronic Communications Law).

Under the terms of the decision now adopted, the request of Tele2 was considered satisfied, in connection with the prior decision of ANACOM of 8 March 2007, which determined that PTC immediately cease the practise followed by the company in respect of pre-selection terminations.

ANACOM decided, on the other hand, to refrain from recognising the request of Tele2, consubstantiated in the determination made to PTC prohibiting the suspension of pre-selection and other dependent services, such as the Subscriber Line Resale Offer (SLRO) and further prohibiting the refusal to activate new pre-selection services and SLRO until such time as the present conflict is settled.  Accordingly, it is understood that, in this matter, no fact exists which corresponds to the existence of a conflict for the purposes of the application of the above legal provision.

Approval was also given to the report on the prior hearing of interested parties, held following the determination of 26 April 2007, which approved the draft decision on the present process of administrative dispute settlement.
