Pre-selection terminations - imposition of obligations upon PTC and Tele2


ANACOM has approved a draft decision on the imposition of specific obligations on PT Comunicações (PTC) and Telemilénio (Tele2) within the scope of pre-selection.
 
This determination of 10 May 2007-05-15 determines that PTC shall refrain from accepting requests for alteration or termination of contract or for deactivation from subscribers of pre-selection providers, pursuant to the deactivation procedures set forth in the Selection and Pre-Selection Regulation (Regulation no. 1/2006, published on 9 January).
 
It is further determined that Tele2 shall, within a period of 10 working days following the final decision, contact all its subscribers whose requests for deactivation and pre-selection have been sent to PTC, in order to gauge their effective willingness with regard to the alteration or termination of the respective contracts. In the event that there are grounds to conclude that a client did not intend to terminate pre-selection, Tele2 shall be released from its obligation to comply with the provisions set out in paragraph 1 of article 10 (concerning deactivation of pre-selection) of the above Regulation.
 
Under the terms of articles 100 and 1001 of the Code of Administrative Procedure, this determination was submitted to a prior hearing of interested parties, for which a period of 10 working days was set for Tele2 and PTC to make their responses in writing.
