Advertising and information of utilitarian nature in telephone directories - amendments


ANACOM gave approval on 26 April 2007 to the amendment of the text of the determination of 8 November on the inclusion of advertising and information of utilitarian nature in telephone directories provided by PT Comunicações (PTC) within the scope of the universal service of electronic communications (US). This determination set out a range of measures with the objective of ensuring that companies authorised to provide electronic communication services may, without any discrimination, use these directories to publicise the services that they offer.

In view of the fact that the terms and application of this determination were linked to a well-defined time frame, it was considered appropriate that the rule set forth therein should be adapted. Furthermore, no regime for service providers commencing their activities after that date was expressly set out. Such a regime should be safeguarded.

The determination to which approval has now been given, determines that the providers of publicly available electronic communications services shall notify PTC of the information which they wish to be included in the opening pages of the directories and that the publication of this information shall be guaranteed provided that it was communicated to PTC no later than 20 days prior to the deadline of the directory edition.

PTC shall inform the providers of electronic communications services, whenever requested, of the inclusion deadline of the edition of each directory whose closure is planned to take place within the following 60 days.

Notification of this measure was made to all providers of publicly available electronic communications services, who are given a period of 10 days to respond under the terms of and pursuant to the provisions of articles 100 and 101 of the Code of General Administrative Procedure.
