Regulation on the methodology for monitoring and measuring intensity levels of electromagnetic fields produced by radiocommunication stations


ANACOM  has approved a Regulation on the methodology for monitoring and measuring intensity levels of electromagnetic fields produced by radiocommunication stations. This regulation specifies on-the-spot measuring procedures for non-ionising electromagnetic radiation (9 kHz – 300 GHz ), in order to assess the electromagnetic fields, for comparison with the reference levels set out in Administrative Rule no.  1421/2004, of 23 November.

Being a draft technical regulation, this Regulation is such as to fall within the scope of Decree-Law no. 58/2000, of 18 April, which lays down the administrative procedures for the exchange of information in the field of technical standards and regulations, and must thus be notified to the European Commission, through the Instituto Português da Qualidade(the Portuguese Quality Institute). Consequently, the publication in the Diário da República as well as the entry into force of this Regulation are suspended until the Commission has ruled thereon and until the defined amendments have been implemented, or until three months have elapsed from the date of receipt of the notification by the Commission.

The final report of the consultation to which the draft regulation was subject, following the determination of 15 May 2003, forms an integral part of this decision. This report, which is at the basis of the options taken by ANACOM, includes the assessment of comments received by APRITEL, Onitelecom, Optimus, PT Comunicações, TMN and Vodafone Telecel.

Pursuant to article 2 of Decree-Law no. 11/2003, of 18 January, ANACOM, following that determination, submitted the draft regulation to the opinion of the Ministries for National Defence, for the Economy, for Science and Higher Education, for Health and for Towns, Territorial Planning and Environment, having received the opinions of the Ministries for National Defence and for Science and Higher Education.
