Minimum set of leased lines and wholesale terminating and wholesale trunk segments of leased lines - review of market assessments


By determination of 30 July 2010, ANACOM approved a draft decision, to be notified to the European Commission, on the definition of product markets and geographic markets, assessments of significant market power (SMP) and imposition, maintenance, alteration or suppression of regulatory obligations on the minimum set of leased lines (former market 7) and wholesale terminating and wholesale trunk segments of leased lines (market 6 and former market 14).

Approval was given also to the report of the prior hearing and public consultation to which the corresponding draft decision was submitted, further to determination of 16 December 2009, in the scope of which comments were received from the Autoridade da Concorrência (the Competition Authority),as well as from the following entities: APRITEL – Associação dos Operadores de Telecomunicações, BT Portugal, Grupo PT (Portugal Telecom SGPS, PT Comunicações, PT Prime, TMN and PT Acessos de Internet Wi-Fi), Grupo SGC AR Telecom, OniTelecom, Rádio e Televisão de Portugal, Sonaecom, Vodafone Portugal and ZON TV Cabo Portugal (on its own account and on the behalf of its affiliates).

This decision has been notified to the European Commission and to regulatory authorities of other Member States, pursuant to article 57, paragraph 1, of the Electronic Communications Law, and to Annex I to Commission Recommendation of 15 October 2008 on notifications, time limits and consultations provided for in Article 7 of Directive 2002/21/EC of the European Parliament and of the Council on a common regulatory framework for electronic communications networks and services.
