Market analysis - Notifications of Portugal to the Commission


On 16 December 2004, ANACOM submitted a notification to the European Commission on the adopted measures concerning the imposition of obligations on narrowband retail markets (markets 1 and 6 of the Commission Recommendation 2003/311/EC, of 11 February, and market 19, notified out of the list of the Commission), pursuant to article 57 of Law no.  5/2004, of 10 February (Regicom) and within the context of article 7 of Directive 2002/21/EC. These measures were adopted by determination of 14 December 2004, regarding the European Commission comments to prior notifications, together with the respective draft decisions, dated 21 July.

ANACOM has also notified the Commission on the measures adopted concerning the imposition of obligations in the wholesale markets for call origination and termination in the public telephone network at a fixed location (markets 8 and 9 of the above-mentioned Recommendation), adopted by determination of 17 December 2004. Also in this case, the corresponding draft decisions had been notified to the European Commission on 21 July.

It is also available at the Communication & Information Resource Centre Administrator (CIRCA) a notification of ANACOM on the draft decision concerning the definition of relevant markets, assessment of significant market power (SMP) and the imposition, maintenance, alteration or withdrawal of regulatory obligations of the unbundled access wholesale market (market 11) and the broadband access wholesale market (market 12), approved on 24 November 2004. The comments of the Commission regarding these notifications do not reflect substantive concerns and refer in particular to the expense methodology for the implementation of price-control obligations in market 11 and the inclusion of wholesale broadband access supported over cable distribution networks in market 12.

The CIRCA also comprises a notification of ANACOM concerning the draft decision on the definition of relevant markets, assessment of significant market power (SMP) and the imposition, maintenance, alteration or withdrawal of regulatory obligations of wholesale services for voice call termination in individual mobile networks (market 16), following the determination dated 21 December 2004.
