Data protection in Europe - public consultation


The European Commission (EC) launched its proposals on the revision of data protection legislation in the European Union (EU), which is available for public consultation until 15 January 2011. The results of this consultation will help set the basis for the revision of Data Protection Directive 95/46/EC, and for the presentation of the new legislation in 2011.

The EC issued a communication document outlining the proposals for modernising data protection rules has the following key objectives:

  • Strengthening individuals rights so that the collection and use of personal data is limited to the minimum necessary;

  • Enhancing the internal market by reducing administrative burden on businesses and ensuring equality conditions for all;

  • Review data protection rules in the areas of police and criminal justice;

  • Ensuring high levels of protection for data transferred outside the EU;

  • More effective enforcement of the rules by strengthening and further harmonising the role and powers of national data protection authorities.
