ANACOM approves Multi-band Auction Regulation


Following ANACOM's approval by determination of 17 October, the Auction Regulation for the allocation of rights of use of frequencies in the 450 MHz, 800 MHz, 900 MHz, 1800 MHz, 2.1 GHz and 2.6 GHz bands has been published in Diário da República (Official Gazette) of 19 October 2011.

ANACOM has also given approval to the report of the regulatory procedure laid down in article 11 of the Statutes of ICP-ANACOM, to which the draft regulation, approved by determination of 13 July 2011, was submitted. Pursuant to this procedure, positions were received from the following entities: Confederação Portuguesa dos Meios de Comunicação Social (Portuguese Media Confederation), Grupo PT (representing Portugal Telecom, SGPS, PT Comunicações, PT Prime and TMN), Grupo ZON Multimédia (comprising ZON TV Cabo, ZON TV Cabo Madeirense and ZON TV Cabo Açoriana), ZAPP.pt (representing MobiZAPP, REPART and ZAPPWIMAX), Optimus - Comunicações and Vodafone Portugal.

A first draft of the auction regulation had been approved by determination of 17 March 2011 (simultaneously to a draft decision on the limitation of rights) and submitted to the regulatory consultation procedure. The complexity of the contributions received, as well as the Memorandum of Understanding (MoU) agreed between the Portuguese Government and the International Monetary Fund (IMF), European Central Bank (ECB) and the European Commission (EC), warranted significant amendments, whereby ANACOM prepared a new draft which is distinct and separate from the first, and whose final version is now approved.
