Introduces the first amendment to Law No 6/97, of 1 March, which authorises the broadcasting of parliamentary sessions on public and private cable TV networks, enabling them to be made available via digital terrestrial television.

Pursuant to article 161 c) of the Constitution, the Assembleia da República hereby decrees as follows:

Article 1

Articles 1 and 2 of Law No 6/97, of 1 March, are hereby amended to read as follows:

«Article 1

1. The Assembleia da República shall make available the signal of its internal video network for the purposes of distributing parliamentary broadcasts on cable television networks and digital terrestrial television broadcasting services.

2. Operators of public use cable television distribution and licensed operators for digital terrestrial television broadcasting services may freely broadcast, via the respective transmission networks, the signal made available by the Assembleia da República, without including commercial advertising or any other elements not resulting from the regime approved by this law and by the respective complimentary instruments.

Article 2

1. All duly licensed operators for public use cable distribution and for digital terrestrial television broadcasting services shall have access to the video signal of the Assembleia da República.

2. The access provided for in the preceding paragraph shall be subject to:

a)  ...

c)  Prior notification to ICP - Autoridade Nacional das Comunicações

Article 2

Law No 6/97, of 1 March, is republished in annex hereto, and shall be deemed to be an integral part hereof.

Article 1
Subject-matter

1. The Assembleia da República shall make available the signal of its internal video network for the purposes of distributing parliamentary broadcasts on cable television networks and digital terrestrial television broadcasting services.

2. Operators of public use cable television distribution and licensed operators for digital terrestrial television broadcasting services may freely broadcast, via the respective transmission networks, the signal made available by the Assembleia da República, without including commercial advertising or any other elements not resulting from the regime approved by this law and by the respective complimentary instruments.

Article 2
Access

1 - All duly licensed operators for public use cable distribution and for digital terrestrial television broadcasting services shall have access to the video signal of the Assembleia da República.

2. The access provided for in the preceding paragraph shall be subject to:

a)  The definition, by resolution of the Assembleia da República, of the general provisions related to modalities, schedules and additional broadcast programming aspects;

b)  The conclusion of a protocol with the Assembleia da República setting definitive terms, conditions and framework rules for the broadcasting of parliamentary sessions;

c)  Prior notification to ICP - Autoridade Nacional das Comunicações.
