Consultation on unfair financial burden in context of the universal postal service


By determination of 5 July 2013, ANACOM has approved a draft decision on the concept of unfair financial burden for purposes of compensating the net cost of the universal postal service.

At issue is the definition of unfair financial burden, as well as the terms governing its determination, including the criteria used, pursuant to Lei Postal (Postal Law - Law no. 17/2012 of 26 April).

It is considered that provision of the universal postal service represents an unfair financial burden for the respective provider whenever the amount of the calculated CLSU - custo líquido do serviço universal (net cost of universal service) is equal to or greater than 2.5 million euros and, at the same time, one of the following conditions is fulfilled: the market share of the universal service provider, in terms of revenues derived from this service, is less than 80 percent, or the calculated CLSU is less than 3 percent of the revenues derived by the universal service provider from the universal postal service.

This draft decision was submitted to the prior hearing of interested parties and to public consultation, with a period of 20 working days provided in both cases. Comments should therefore be submitted no later than 8 August 2013, and should be sent by email to consulta.clsupostal@anacom.ptmailto:consulta.clsupostal@anacom.pt1.

Once the consultation process has been concluded, the contributions received will be made public, whereby interested parties should also submit a non-confidential version of their responses excluding items considered confidential for the purposes of publication on this website.
