ANACOM adopts provisional and urgent measures on fixed network call termination


By determination of 27 August, and with immediate effect, ANACOM has approved the provisional and urgent measures contained in the document "Wholesale market for call termination on the public telephone network at a fixed location - Definition of product markets and geographic markets, assessment of SMP and imposition, maintenance or suppression of regulatory obligations". This document includes the determination of new termination rates to apply from 01 October 2013, based on the reasoning set out in the report on the prior hearing and public consultation prepared by ANACOM on 12 July 2013. This reasoning in this report is maintained, although emphasis must be given to the caveats set out in the report as relates to the obligations questioned in the European Commission (EC) Communication sent on 12 August 2013.

ANACOM also determined that the provisional and urgent measures will remain in force until conclusion of a new procedure of definition of product markets and geographic markets, assessment of SMP and imposition, maintenance or suppression of regulatory obligations, including respective notification to the EC and ANACOM's final decision.

It was also decided to inform the EC, the other national regulatory authorities (NRA) and the Body of European Regulators of Electronic Communications (BEREC) as to the measures adopted and the respective reasoning, as well as to notify interested parties to the present decision.
