Resolution of Council of Ministers no. 66-A/2013 - additional information


Published in the Diário da República (Official Journal) on 18 October, Resolution of Council of Ministers no. 66-A/2013 defines a set of measures as related to the revocation of the public telecommunications service concession contract and as related to the universal service of electronic communications, determining in particular the following:

  • approval of the terms of the agreement to be concluded between the Portuguese State and PT Comunicações (PTC) as regards the revocation of the public telecommunications services concession contract, the bases of which were approved by Decree-Law no. 31/2003 of 17 February;
  • delegation of powers to the Minister of State and of Finance and to the Minister of Economy, with the option to sub-delegate authority to conclude the agreement on behalf of the Government;
  • authorization to undertake the expenditure inherent to the compensation payable to PTC for early termination of the services covered by the public telecommunications service concession contract, to a maximum of 33.5 million euros, payable in 2014;
  • award, under the procedure restricted by pre-qualification to select the undertaking(s) to be designated to provide the universal service of connection to a public communications network at a fixed location and provision of publicly available telephone services, to Optimus Comunicações (in the north and centre of the country) and to ZON TV Cabo (in the south and islands);
  • award, under the procedure restricted by pre-qualification to select the undertaking(s) to be designated to provide the universal service of public pay-telephones, to PTC in the entire national territory;
  • presentation, by the Minister of Economy, following the revocation of the public telecommunications service concession contract, of the legislative initiatives necessary to repeal a series of laws - Law no. 91/1997 of 1 August, Decree-Law no. 31/2003 of 17 February and Decree-Law no. 95/2003 of 3 May;
  • discontinuation of provision, as a public service, of the fixed telex, fixed switched data transmission and telegraph services, as from 31 January 2014.
