Portability - Mundio Mobile in situation of non-compliance


By determination of 19 December 2013, ANACOM has approved a determination ordering Mundio Mobile to adopt measures to resolve a situation of non-compliance detected in the company's exercise of the activity of mobile telephone service provider, as virtual mobile operator (MVNO). As such, Mundio Mobile has been ordered to comply immediately with the condition of guaranteeing portability as required under the terms of the LCE - Lei das Comunicações Eletrónicas Electrónicas (Electronic Communications Law), the Regulamento da Portabilidade (Portability Regulation) and, as holder of rights of use of numbers, the contract concluded with the Portability Reference Entity.

In the event that the company fails to comply, ANACOM has approved a set of determinations including:

a) suspension of the activity exercised by MUNDIO MOBILE as provider of the mobile telephone service, including the short message service (SMS) and data service, until such time as the present situation of non-compliance is resolved; the date on which such suspension takes effect shall be as strictly necessary in order to allow the company to fulfil its obligation of informing users;
 
b) revocation, following the quarantine period, as elapsing from the date of the final decision, of the rights of use of numbers granted to MUNDIO MOBILE (the rights of use of numbers already ported are excluded from this measure).

It was decided to submit this draft decision to the prior hearing of Mundio Mobile, of Optimus - Comunicações, S.A. and of PORTABIL - Bases de Dados para a Portabilidade em Telecomunicações, S.A., whereby a period of ten working days has been provided for interested parties to state their positions in writing
