Market 3 and fixed termination costing model under public consultation


By determination of 10 July 2014, ANACOM has approved a draft decision on the definition of the wholesale market of call termination on the public telephone network at a fixed location, and on the assessment of significant market power (SMP) and imposition, maintenance, amendment or withdrawal of regulatory obligations in this market. In this context, all operators providing the wholesale voice call termination service were identified as having SMP.

Among the obligations to which SMP operators are subject, is the obligation to control prices, whereby the amount operators charge for termination is made subject to a maximum price, which is determined based on the costing model developed for this purpose.

On the same date, approval was also given to the draft decision on the fixed termination costing model. This decision was preceded by a public consultation on the methodological options to be considered in the development and implementation of the model, launched by ANACOM determination of 27 November 2013. The report on this consultation has also been approved by the present determination.

The costing model determines that the maximum price of voice call termination on fixed networks, as may be applied by fixed operators notified with SMP, is 0.068 eurocents per minute, regardless of call origin, with billing per second from the first second. This maximum price is to be applied within 10 days following adoption of the final decision.

These draft decisions were submitted to the prior hearing of interested parties, under the Código de Procedimento Administrativo (Administrative Proceeding Code), and also to the general consultation procedure laid down in article 8 of Lei das Comunicações Eletrónicas (Electronic Communications Law - Law no. 5/2004 of 10 February, as amended and republished by Law no. 51/2011 of 13 September, and as amended subsequently). In both cases, a period of 30 working days was provided for the receipt of comments. As such comments must be received no later than 26 August 2014, and should be sent by email to mercado3@anacom.ptmailto:mercado3@anacom.pt1.

Once the consultation process is concluded, the responses received will be published on this website. Therefore, for the purpose of publication, interested parties should also submit a non-confidential version of their comments having removed any items considered confidential.
