Decision on the disclosure of information on postal establishments
Whereas:
- CTT - Correios de Portugal, S.A. (CTT) is provider of the universal postal service in the Portuguese national territory until 31.12.2020 (in accordance with paragraph 1 of article 57 of Law no. 17/2012 of 26 April, as amended by Decree-Law no. 160/2013 of 19 November and by Law no. 16/2014 of 4 April);
- as universal postal service concessionaire, CTT is bound to ensure public disclosure of information, in an appropriate manner including on its website, as regards the general conditions governing access to and use of services, which information is also to be provided on a regular basis to users [in accordance with point f) of paragraph 1 of the Bases VIII of the Bases da concessão do serviço postal universal (Bases of the Universal Postal Service Concession) as approved by Decree-Law no. 448/99 of 4 November and as republished in annex to Decree-Law no. 160/2013 of 19 November];
- by determination of 28 August 2014 and subsequent to the prior hearing of CTT and of users, ICP - Autoridade Nacional de Comunicações (ICP-ANACOM), pursuant to paragraph 6 of Base XV of the Bases da concessão do serviço postal universal (Bases of the Universal Postal Service Concession), defined the objectives of postal network density and minimum offers of services to be provided by CTT between 01 October 2014 and 30 September 2017;
- taking into account the contributions received in response to the prior hearing of CTT and of users, in the same determination, ICP-ANACOM also instructed CTT to make public and maintain up-to-date information on its website, within 2 months, as regards all postal establishments in operation (post offices and postal agencies), including, specifically, information on their locations and opening hours and on the services provided, which (new) deliberative point was submitted to the prior hearing of CTT and of users for a period of 15 working days;
and considering:
- the contributions received, within the period stipulated for the purpose, in response to the prior hearing of CTT and of users on the disclosure of information by CTT about the postal establishments in operation;
- the analysis of the contributions received, as set out in the "Report of the prior hearing of CTT and of users on the Draft Decision on the disclosure of information on postal establishments",
in exercise of the powers conferred by points b), d), h) and n) of paragraph 1 of article 6 and by point b) of article 26 of its Statutes, as approved by Decree-Law no. 309/2001 of 7 December, and as under paragraph 1 of article 8 of Law no. 17/2012 of 26 April, as amended by Decree-Law no. 160/2013 of 19 November and by Law no. 16/2014 of 4 April, in the pursuit and fulfilment of the objectives and principles set out in points a) and d) of paragraph 2 of article 2 of said Law and pursuant to point f) of paragraph 1 of Base VIII of the Bases da concessão do serviço postal universal (Bases of the Universal Postal Service Concession), as approved by Decree-Law no. 448/99 of 4 November and as republished in annex to Decree-Law no. 160/2013 of 19 November, the Management Board of ICP-ANACOM determines:
1. To approve the "Report on the prior hearing of CTT and of users on the Draft Decision on the disclosure of information about postal establishments", which report forms an integral part of the present decision;
2. That CTT is to make public and maintain up-to-date information on its website, no later than 2 months following the date of the present decision, as regards all postal establishments in operation (post offices and postal agencies), including, specifically, information on their locations and opening hours and on the services provided.
