Resolution of the Council of Ministers No. 16/2013, of 21 March, authorizes the expenditure relating to the conclusion of contracts of the second stage of the International Partnership Programme, the acquisition of contents to be provided via b-on and contributions to be paid by Portugal as member of international organizations, bearing in mind the relevance of Portugal’s continued participation in international scientific and technological organizations, not only for the scientific community but also for the national entrepreneurial sector.

Under the referred resolution, charges that correspond to Portugal’s contributions in international organizations, among which the European Space Agency (ESA), for the period between 2013 and 2018, shall be borne by means of appropriate funds entered and to be entered in the budget of Fundação para a Ciência e a Tecnologia, I. P. (FCT - the Foundation for Science and Technology).

ICP - Autoridade Nacional das Comunicações (ICP-ANACOM) plays a relevant role as regards Portugal’s participation in ESA, as it represents the country in ESA’s Committees for Management of Telecommunications Programmes («ARTES» programmes), and other public bodies benefit from this participation.

Accordingly, Resolution of the Council of Ministers No. 16/2013, of 21 March, must thus be amended, in the part that determines that the financial burden related to contributions to ESA must be borne by funds entered and to be entered in the budget of FCT, I.P., to establish that the burden for 2014 shall be borne partly by FCT, I.P. and partly by ICP-ANACOM’s net results for 2013 that revert to the State.

Therefore:

Pursuant to point e) of paragraph 1 of article 17 and to paragraph 1 of article 22 of Decree-Law No. 197/99, of 8 June, to point a) of paragraph 1 of article 6 of Law No. 8/2012, of 21 February, to paragraph 1 of article 11 of Decree-Law No. 127/2012, of 21 June, and to point g) of article 199 of the Constitution, the Council of Ministers hereby decides:

1 - To amend paragraph 4 of Resolution of the Council of Ministers No. 16/2013, of 21 March, which shall read as follows:

«4 - To determine that the burden referred to in paragraphs 2 and 3 shall be borne by appropriate funds entered and to be entered in the budget of FCT, I.P., except for the burden related to Portugal’s contributions to the European Space Agency (ESA), for 2014, which shall be borne as follows:

a) 9 694 000 EUR (nine million, six-hundred and ninety-four thousand Euro) by appropriate funds entered in the budget of FCT, I.P.;

b) 6 000 000 EUR (six million Euro), to be transferred to ESA, on account of net results for 2013 of ICP - Autoridade Nacional das Comunicações (ICP-ANACOM) that revert to the State.»

2 - To determine that this Resolution takes effect from the date of approval hereof.
