NOS exempted from contributing to the universal service compensation fund


By decision of 25 February 2016, ANACOM has granted NOS Comunicações (NOS) exemption from the requirement to deliver the value of its required contribution to the universal service compensation fund in respect of the CLSU - Custos Líquidos do Serviço Universal (Net Costs of Universal Service) of 2014 (period following designation of the universal service provider by public tender). The value of this contribution is exceeded by the value of compensation that the company is entitled to receive as provider of the universal service of connection to a public communications network at a fixed location and of publicly available telephone services.

It is recalled that, by ANACOM decisionhttps://www.anacom.pt/render.jsp?contentId=1378687 of 28 January 2016 identifying the undertakings required to contribute to the electronic communications universal service compensation fund and determining the amount of the contributions in respect of the CLSU - Custos Líquidos do Serviço Universal (Net Costs of Universal Service) to be compensated for the 2010-2011 period (CLSU approved in 2014) and for 2014 (the period subsequent to the designation of universal service providers by public tender), NOS was designated as an undertaking bound to contribute to the compensation fund, whereas, as universal service provider, it is entitled to remuneration in respect of this provision.

Given these conditions, it was decided to grant the request put by NOS, on 19 February 2016, to be exempted from delivering the value of its contribution to the universal service compensation fund in respect of the CLSU 2014 (period subsequent to the designation of universal service providers by public tender).
