Consultation on analysis of the market of high-quality electronic communications at a fixed location


On 10 March 2016, ANACOM approved the launch of a public consultation on the definition of the market of high-quality electronic communications at a fixed location, assessment of significant market power (SMP) and imposition, maintenance, amendment or withdrawal of regulatory obligations (market 4 of Recommendation 2014/710/EU).

In this analysis, the following wholesale markets have been identified as relevant for the purposes of ex-ante regulation: high-quality access in NC areas - low speed (i.e. not exceeding 24 Mbps); high-quality access in NC areas - high speed (i.e. exceeding 24 Mbps); trunk segments of leased lines, without distinction of speed, comprising NC routes (not including Mainland-Azores-Madeira (CAM) and inter-island circuits); trunk segments of leased lines, without distinction of speed, comprising CAM and inter-island circuits; and trunk segments of leased lines, without distinction of speed, comprising circuits giving access to international submarine cables anchored to the submarine cable stations of MEO - Serviços de Comunicações e Multimédia (MEO) in Carcavelos and Sesimbra.

It was concluded that MEO has SMP in the identified relevant markets and therefore that obligations should be imposed as follows: obligations of network access and as regards use of specific network resources, non-discrimination, transparency, accounting separation and price control, and cost accounting and financial reporting.

Stakeholders have been granted a period of 30 working days in which to comment in writing (in Portuguese). As such, comments are to be received no later than 28 April 2016, and should be sent by email to mercado4@anacom.ptmailto:mercado4@anacom.pt1.

Once the consultation process has been concluded, the contributions received will be made public. Therefore, for the purposes of publication on this website, interested parties should also submit a non-confidential version of their responses, excluding any items considered confidential.
