Revision of reference speeds associated with coverage obligations in the 800 MHz band in 2018


On 5 May 2016, ANACOM approved a draft decision on the timeframe for the revision of the reference speeds associated with coverage obligations in the 800 MHz frequency band. These obligations apply, pursuant to Regulation no. 560-A/2011https://www.anacom.pt/render.jsp?contentId=1102165 of 19 October (Auction Regulation), to MEO - Serviços de Comunicações e Multimédia (MEO), NOS Comunicações (NOS) and Vodafone Portugal - Comunicações Pessoais (Vodafone).

As such, considering that the reference speeds associated with the coverage obligations in the 800 MHz band were first set by ANACOM Decisionhttps://www.anacom.pt/render.jsp?contentId=1381268 of 3 March 2016 and that the Decisionhttps://www.anacom.pt/render.jsp?contentId=1381291 on the end of operating restrictions in the 800 MHz band was notified to MEO, NOS and Vodafone on 10 March 2016, ANACOM will revise the reference speeds for the first time in 2018 (and subsequently every two years).

Therefore, pursuant to article 34 paragraph 7 of the Auction Regulation, which stipulates that “the revision of the maximum speed (…) is to be conducted every two years”, and for the purposes of the revision of the reference speeds associated with the coverage obligations in the 800 MHz frequency band, ANACOM has ordered MEO, NOS and Vodafone to send it ordered lists of their customers. These lists are to be prepared in accordance with the methodology given in ANACOM’s decisionhttps://www.anacom.pt/render.jsp?contentId=1195476 of 21 March 2014, with reference to customers as on 31 March 2018 (and every two years subsequently) and sent to ANACOM no later than 31 May 2018 (and every two years subsequently).

This draft decision is submitted to a prior hearing of stakeholders for a period of 10 working days under the terms of the Código de Procedimento Administrativo (Administrative Proceeding Code).
