Notification to the European Commission of market analysis review (markets 3a and 3b)


By decision of 30 June 2016, ANACOM has approved the draft final decision for notification to the European Commission (EC), the Body of European Regulators for Electronic Communications (BEREC) and the national regulatory authorities (NRAs) of the other Member States of the European Union, on the analysis of the markets of wholesale local access at a fixed location (market 3a) and of wholesale central access at a fixed location for mass-market products (market 3b), which includes definition of product and geographic markets, assessment of significant market power (SMP) and the imposition, maintenance, amendment or withdrawal of regulatory obligations.

In this analysis, ANACOM identified the following markets as being relevant for the purposes of ex ante regulation: wholesale local access market at a fixed location and wholesale central access market at a fixed location (for mass-market products) in non-competitive areas (NC).

Based on its analysis of these markets, ANACOM concluded that MEO has SMP in both markets, thereby imposing obligations of access to the network and use of specific network resources, non-discrimination, transparency, accounting separation and price control and cost accounting and financial reporting. ANACOM also concluded that the wholesale central access market at a fixed location (for mass-market products) in competitive areas is not susceptible to ex ante regulation.

Approval was also given to the report of the prior hearing and consultation to which the respective draft decision was submitted (draft decision of 11 February 2016).
