Commencement of procedure to prepare a Regulation aimed at setting out rules to govern the use of geographic and mobile numbers in nomadic situations


Under the terms of and for the purposes set out in paragraph 1 of article 98 of the Código do Procedimento Administrativo (Administrative Proceeding Code), notice is given as follows:

  • Under the powers provided for in points a), d), f) and h) of paragraph 1 of Article 8 of the Statutes of Autoridade Nacional de Comunicações (ANACOM) (approved by Decree-Law no. 39/2015 of 16 Marchhttps://www.anacom.pt/render.jsp?contentId=1351851), in the pursuit of the regulatory objectives set out in points a) and c) of paragraph 1, point d) of paragraph 2 and point g) of paragraph 4 of article 5 of Law no. 5/2004 of 10 February, as presently worded, and under points b) and f) of paragraph 2 of article 17 and paragraph 1 of article 125, also of Law no. 5/2004 of 10 Februaryhttps://www.anacom.pt/render.jsp?contentId=1351851, and point a) of paragraph 2 of article 9 and point b) of paragraph 1 of article 26 both of ANACOM's Statutes, on 14 July 2016, the Board of Directors of ANACOM decided to commence a procedure to prepare a Regulation aimed at establishing rules to govern the use of geographic and mobile numbers in nomadic situations.
  • Considering the current technical factors which prevent provision of information on the location of a person originating a call made using the nomadic telephone service, also considering the statutory and regulatory restrictions which apply to the use of geographic and mobile numbers and in view of the emergence on the market of certain offers in which customers using geographic and mobile numbers are being offered VoIP applications (Voice over Internet protocol) which fall outside the scope of the mobile telephone services and the telephone service at a fixed location (insofar as such services are associated with characteristics which are typical services of a nomadic service), ANACOM considers that it is opportune and fitting to again address this matter, setting out the establishment of a set of rules aimed at facilitating the use of geographic and mobile numbers in nomadic situations in accordance with the terms laid down in Annex to the present notice.
  • Interested parties may submit written contributions and suggestions as they deem fit for consideration under the present regulatory procedure; these must be submitted to ANACOM within a period of 20 working days from the date of this publication using the following address: regras.nomadismo@anacom.ptmailto:regras.nomadismo@anacom.pt1.
  • At a later date, interested parties will be given an opportunity to comment on the draft Regulation, which will be submitted to public consultation in accordance with the provisions of article 10 of the Statutes of ANACOM (approved by Decree-Law no. 39/2015 of 16 March).
  • The draft Regulation will be published on ANACOM's institutional website and in the 2nd Series of Diário da República (Official Gazette).
  • ANACOM will examine the contributions and suggestions advanced by interested parties, and with the approval of the Regulation in question, will produce a report making reference to all responses received and providing an overall assessment that reflects ANACOM's position thereon and the reasoning for the options taken.
