Roaming - Implementing Regulation published


On December 17th 2016 the Official Journal of the European Union published Implementing Regulation (EU) 2016/2286 issued by the Commissionhttps://www.anacom.pt/render.jsp?contentId=1401619 on December 15th 2016, laying down detailed rules on the application of fair use policy and on the methodology for assessing the sustainability of the abolition of retail roaming surcharges and on the application to be submitted by a roaming provider for the purposes of that assessment. This Regulation affords compliance with the provisions of the TSM Regulation (2015/2120) issued by the European Parliament and Councilhttps://www.anacom.pt/render.jsp?contentId=1373317 on November 25th 2015 in which the European Commission would have to define the fair use limits by December 15th 2016.

On the same date Implementing Regulation (EU) 2016/2292 was published, issued by the Commission on December 16th 2016 which sets out the weighted average of maximum mobile termination rates across the Union, repealing Implementing Regulation (EU) 2015/2352.

Both Regulations come into force on the twentieth day subsequent to that of their publication in the Official Journal of the European Union.
