The Body of European Regulators for Electronic Communications (BEREC) has published its response to the public consultation launched by the European Commission on the review of the 2002 guidelines on market analysis and the assessment of significant market power; the consultation closed on 26 June 2017.
BEREC made the following points in its response:
- the revision of these guidelines should have been carried out consecutively to the review of the new regulatory framework, so that any evolution of the Framework might be taken into account;
- the need to address competition issues derived from "tight oligopolies";
- the urgency of obtaining guidance on identifying joint dominance.
