Statement of Rectification
(This is not an official translation of the law)
Regulation No. 255/2017, regarding the provision of statistical information, which establishes the manner, level of detail, deadlines and frequency of the submission of statistical information which undertakings providing electronic communication networks and services are required to report to ANACOM on a regular basis, was published in the Diário da República (Official Gazette), 2nd Series, No. 94, of 16 May 2017.
The table of Annex 2 - Quarterly questionnaire on Electronic Communication Networks and Services - was published with some inaccuracies, such that its rectification is deemed necessary:
In the "Unit" column of indicator I.5.1, by mistake, the unit intended is not presented. It is thus rectified by adding "1 Access".
The "Definition" column of indicator I.6.3.3 was published with the following inaccuracy, which us thus rectified:
Where it says:
"[...] The mere use of voice, Short Message Service (SMS) and Multimedia Message Service (MMS) is excluded,"
It should read:
"[...] The mere use of voice, Short Message Service (SMS) and Multimedia Message Service (MMS) is excluded."
The "Definition" column of indicator I.6.3.3.1 was published with the following inaccuracy, which is thus rectified:
Where it says:
"[of which] used a PC/tablet/pen/router in the last month of the quarter. These are generally mobile accesses associated to offers that include the Internet mobile access service and exclude voice calls associated to the mobile telephone service.
The mobile accesses supported in mobile phones and smartphones are excluded. (In this case, these are normally offers that include voice calls associated to the mobile telephone service and mobile Internet access)."
It should read:
"[of which] used a PC/tablet/pen/router in the last month of the quarter. These are generally mobile accesses associated to offers that include the Internet mobile access service and exclude voice calls associated to the mobile telephone service.
The mobile accesses supported in mobile phones and smartphones are excluded. (In this case, these are normally offers that include voice calls associated to the mobile telephone service and mobile Internet access)."
The "Definition" column of indicator IV.1.6 was published with the following inaccuracy, which is thus rectified:
Where it says:
"Excludes the monthly charges of additional mobile cards included in bundled offers that must be reported in the indicators associated to mobile services (IV.1.5 if following)"
It should read:
"Excludes the monthly charges of additional mobile cards included in bundled offers that must be reported in the indicators associated to mobile services (IV.1.5 et seq.)".
The tables of Annex 6 - Annual questionnaire - of the same regulation were published with some of its fields, options of completion and corresponding notes included therein misconfigured, affecting their reading and understanding. As such, their rectification is deemed necessary.
