Amendments to the Reference Unbundling Offer (RUO) - consultation


On 10 August 2017, ANACOM approved a draft decision on amendments to the Reference Unbundling Offer (RUO).

In ANACOM decision of 23 March 2017https://www.anacom.pt/render.jsp?contentId=1408076 regarding the analysis of the wholesale local access provided at a fixed location (Market 3a), it is concluded that, notwithstanding developments in terms of next generation networks, it remains essential to maintain the obligation of unbundled access to the copper loop, as constituted in the RUO of MEO - Serviços de Comunicações e Multimédia (MEO), as the operator with significant market power.

In this market analysis, ANACOM acknowledged the need for additional amendments to this offer, noting that it would only intervene on specific points, as duly substantiated by the beneficiaries of the offer and as would be essential to ensure the development of their retail offers; ANACOM may likewise accept amendments to the RUO proposed by MEO, provided that they are duly substantiated and provided that the views of beneficiaries are heard.

On 10 April 2017, ANACOM sought concrete proposals from all RUO beneficiaries to improve the offer, duly reasoned in light of the reported decline in demand for unbundled loops. On the same date, and seeking to enrich the current analysis, MEO was asked to express its views on possible amendments to the offer, duly reasoned and considering any proposals received from the RUO’s beneficiary operators.
The draft decision now approved by ANACOM defines a set of changes to the RUO, in consideration of the performed analysis and the reasoning set out by the interested parties.

It was also decided to submit this draft decision to the prior hearing of interested parties under articles 121 et seq. of Código do Procedimento Administrativo (Administrative Proceeding Code), as well as the general consultation procedure laid down in article 8 of Lei das Comunicações Eletrónicas (Electronic Communications Law - Law no. 5/2004 of 10 February, in its present form). A period of 30 working days is provided under both procedures for interested parties to comment in writing and in Portuguese.

Comments should therefore be sent no later than 25 September 2017, by email to SPDORALL@anacom.pt1. Once the consultation process has been concluded, the contributions received will be made public. Therefore, for the purposes of publication on this website, interested parties should also submit a non-confidential version of their responses excluding items considered confidential.
