Fixed origination market - notification to the European Commission


On 19 October 2017, ANACOM approved the draft decision to be notified to the European Commission (EC), the Body of European Regulators of Electronic Communications (BEREC) and the national regulatory authorities (NRA) of the other Member States of the European Union (EU) on the wholesale market for call origination on the public telephone network provided at a fixed location (formerly Market 2 of Recommendation 2007/879/EC).

According to the analysis carried out, only the wholesale market for Call origination on the public telephone network provided at a fixed location enabling provision of retail services, supported by indirect access, is subject to ex ante regulation.

MEO - Communication and Multimedia Services (MEO) has significant market power (SMP) in this market, and therefore a range of ex-ante regulatory obligations are imposed on this operator, including:

  • obligation to respond to reasonable requests for access;
  • non-discrimination;
  • transparency in the publication of information;
  • price control;
  • accounting separation and cost accounting.

In relation to the wholesale market for call origination on the public telephone network provided at a fixed location enabling provision of special services supported by non-geographic numbering, it was concluded that it was not subject to ex-ante regulation and therefore regulatory obligations which are currently imposed on MEO, as having SMP in that market, are withdrawn.
