ANACOM gives Fibroglobal 15 days to state its position on the reduction in prices (reduction between 24% and 55%)

ANACOM has received a mandate from the Government to conduct a process to reduce Fibroglobal's prices by between 24% and 55%, as recommended following the analysis of the pricing of wholesale offers supported over rural high-speed networks which ANACOM concluded in October. In this respect, ANACOM has now given Fibroglobal a period of 15 working days to set out its position on the reduction of the prices of its offers.

The prior hearing will also hear the position of DSTelecom and all the service providers registered with ANACOM, since they constitute potential beneficiaries of the wholesale offer made available by Fibroglobal.

However, a possible final decision of the public contractor, (Portuguese State), following the prior hearing on the reduction of prices, will be constituted as an order to reduce prices issued by the Portuguese State to Fibroglobal.

It should be recalled that in its analysis of the pricing of the wholesale offers supported over rural high-speed networks, ANACOM concluded that the prices charged by Fibroglobal are very high - it was for this reason that the Government proposed a reduction in the prices charged by Fibroglobal of between 24% and 55%, depending on the type of access.

In its analysis, ANACOM also checked the wholesale offers of DSTelecom (which operates rural high-speed network in the North zone of Portugal, the Alentejo and the Algarve), and concluded that the prices charged by Fibroglobal (Central Zone of Portugal and the Azores) are substantially higher.

In accordance with the mandate it has received from the Portuguese government, ANACOM has also requested information from a number of operators, including Fibroglobal and DSTelecom, as to the existence of over-financing. This situation must be verified every 5 years over the duration of the contracts - this time limit has now passed. In the event that there is over-financing, the reimbursement mechanism will be activated.

Under the terms of the contracts, the allocation of public funds constitutes over-financing where the profit arising from the operation of the high-speed network exceeds the sector average.
