ANACOM decides to deregulate the market for origination of calls to non-geographic numbers


On 14 December 2017, ANACOM approved deregulation of the market for call origination on the public telephone network provided at a fixed location enabling provision of special services supported by non-geographic numbering.

This decision stems from the analysis of the wholesale market for call origination on the public telephone network provided at a fixed location, which was notified to the European Commission upon approval by ANACOM on 19 October 2017https://www.anacom.pt/render.jsp?contentId=1421373. Following this notification, the Commission considered that ANACOM could proceed with deregulating the wholesale market for call origination on the public telephone network provided at a fixed location enabling provision of special services supported by non-geographic numbering, as proposed.

The analysis carried out by ANACOM concluded that this market does not cumulatively meet the three criteria set out in EC Recommendation 2014/710/EU of 9 October 2014https://www.anacom.pt/render.jsp?contentId=1336427 on relevant markets, as would make it susceptible to ex-ante regulation. Consequently, there are also no operators designated as having significant market power in this wholesale market.

Accordingly, upon adoption of the final decision, the obligations imposed in this market on MEO - Serviços de Comunicações e Multimédia (MEO) will cease to apply, except for the price control obligation, which must continue to apply for a further 6 months following adoption of the decision (whereby the prices for this type of origination will remain unchanged during the period concerned).

Approval was also given to this decision’s notification to the European Commission, Autoridade da Concorrência (Portuguese Competition Authority), MEO and other interested parties.
