By determination of 13 April 2018, ANACOM has approved a draft decision on the Wholesale market for call origination on the public telephone network provided at a fixed location for the provision of retail telephone services - definition of product and geographic market, assessment of significant market power (SMP) and imposition, maintenance, amendment or withdrawal of regulatory obligations.
According to ANACOM's analysis, in Portugal the wholesale market for call origination in the public telephone network at a fixed location for the provision of retail services, supported by indirect access (call-to-call selection and pre-call screening), has a national dimension.
It is further deemed that this market does not cumulatively meet the three criteria set out in the Recommendationhttps://www.anacom.pt/render.jsp?contentId=1336427 on relevant markets. Consequently, and since there are no operators designated as enjoying SMP in this wholesale market, the obligations imposed on MEO - Serviços de Comunicações e Multimédia cease to apply (except as regards the price control obligation, which is maintained in its current form and subject to currently applicable values in accordance with the RIO and the SLRO; the price control obligation can only be withdrawn 1 year following the decision on this market).
This draft decision is submitted to the prior hearing of interested parties, in accordance with Código de Procedimento Administrativo (Administrative Proceeding Code), as well as to the general consultation procedure established in Article 8 of Lei das Comunicações Eletrónicas (Electronic Communications Lawhttps://www.anacom.pt/render.jsp?categoryId=333114). The deadline for the receipt of comments was set at 30 working days (01 June 2018).
