ANACOM approved, by decision of 3 May 2018, the draft decisions to be notified to the European Commission, the Body of European Regulators of Electronic Communications (BEREC) and the national regulatory authorities of the other Member States of the European Union, concerning the wholesale markets for voice call termination on individual mobile networks, covering:
- definition of product markets and geographic markets, assessment of significant market power (SMP) and the imposition, maintenance, amendment or withdrawal of regulatory obligations,
- the specification of the price control obligation for this wholesale market.
Following its analysis, ANACOM considers that the wholesale markets for voice call termination in the mobile network in Portugal are of a size that corresponds to the network of the provider that provides the service and involve the provision to third parties of the wholesale voice call termination service by mobile network operators and virtual mobile operators, regardless of the type of network, technology, of the originating entity and the geographical origin of calls.
ANACOM also concludes that all providers providing the voice call termination service in individual mobile networks have SMP in this market, and that these providers may be mobile operators with their own network or virtual mobile operators (MVNO).
Accordingly, ANACOM considers that the obligations of access, transparency and non-discrimination and the obligation of price control are justified and that termination prices should be set at appropriate levels. They should reflect the cost of providing the mobile termination service by an efficient provider, ensuring that there is no difference in the collection of such prices between the providers of these services, nor obstacles to access and information relevant to the correct functioning of the market.
In this context, ANACOM also determined that the maximum price for the termination of voice calls in mobile networks to be applied by the notified mobile operators with SMP will be 0.45 euro cents per minute, from 10 working days after publication of the final decision regarding to the present procedure with respect to the prices for 2018, with a billing per second from the first second.
At the same time, the reports on the prior hearing and public consultation to which the respective draft decisions approved on 18 January 2018https://www.anacom.pt/render.jsp?contentId=1428409 were subject to were approved.
